Condominium Association Governance
The Ravines at McCammon Chase Condominium Association Board of Directors retains legal counsel Kaman & Cusimano, LLC for guidance on governance of the property Declarations and Bylaws, including Board promulgated Rules and Regulations for the community. The Declarations and Bylaws were written and filed at Delaware County, Ohio under legislative control described in Ohio Revised Code Section 5311. The Declarations and Bylaws for The Ravines at McCammon Chase require 75% voting homeowner approval to amend either document.
The Association Board believes in transparency of its business governing the organization's business. The Board meets to conduct its business monthly (date and time determined ad hoc), however, condominium owners are invited to listen to business discussed, except for discussions to be held in executive session. Condominium owners interested in listening to association business being conducted should contact the Board Secretary for scheduled dates, times and venue. Condominium Association Dues & Collection Policy
The Ravines at McCammon Chase Condominium Association Board is responsible for setting dues (revenues) for the Condominium community. The monthly assessment of dues are typically set to cover all operating expenses, plus the reserve fund. The Association Board encourages condominium owners to review the community's financial statements to understand where funds collected are spent.
Condominium Association assessments are due of the first day of the month and are considered late if not received by the 10th day of the month ("the late day"). Onyx Realty Community Property Management (Onyx Realty) is the remittance authority for collecting Association dues. Condominium Unit Exterior (Land) Modifications
Condominium owners should always keep in mind that The Ravines is a condominium community and all land within the boundaries of the community are designated either Common Elements (CE) or Limited Common Elements (LCE). This means condominium owners do not personally own the land around their home, however, have an undivided 1/35th ownership interest in the Common Elements.
Rules and Regulations are adopted to govern the use of the CE and LCE of the Condominium Property, as defined in the recorded Declaration and Bylaws of the Ravines at McCammon Chase Condominium Association. The recorded Declaration and Bylaws may be found at Volume 1491 and page 1675 of the Delaware county records.
Condominium owners seeking to modify the exterior of their unit must have their plans approved by the Association Board prior to commencing work. This approval process requires a completed Application For Alteration/Modification. Onyx Realty Community Association Management (Onyx Realty) utilizes a web portal [AppFolio] for communications and requests for exterior modifications and architectural reviews should be submitted using the AppFolio portal. Condominium owners are required to attest whether their alteration and/or modification does or does not encroach on Common Elements.
If the alteration and/or modification does encroach Common Elements, the Association Board may approve such application IF an “Easement in Agreement of Covenants” document, prepared by an attorney, is signed and agreed to by the condominium owner, and filed at Delaware County. Legal fees estimated at approximately $600, plus recording fees, must be paid by the condominium owner.
This is a legal and binding document that shifts future maintenance and repair responsibility of that particular Common Element to the condominium owner, and all future purchasers (owners) of that condominium unit.
